      And also, you will have to pay Ambrosia for use of Coldstone (If you want to distribute it for a fee, that is.) Look into the pond before you jump to the stone.

    • Just like with Efeion's site, pngs don't work well with most browsers, try using gifs or jpegs.

      I am currently not sure if I am going to sell it for a fee or have it as freeware. But if I Try to sell it through Ambrosia I don't believe there will be a problem.

      It doesn't say that anywhere, that's the problem. I just found that out when I called them. Read the post I made in Efeion's 'question forum' to see what they said. Believe me, I was shocked to hear of a 'hidden catch' too.

      That is not the only thing I am concerned about. If I give Ambrosia the game to look at it, what stops them from stealing the game and claiming it to be their own?

      There's no 'hidden catch', their terms are laid out in the documentation, the FAQ section of this webboard, and Mr. Dunham recently made a post concerning the matter. If you want to make false statements, tell both sides of the story, such as how you presented yourself when you asked Ambrosia.

      Now this is just silly. No, skip that, it's just stupid.
      Ambrosia won't even look at your game without both parties signing a Non Disclosure Agreement.
      They are not the biggest name in Macintosh Shareware because they stole some kids idea.

      Sorry, but I have delt with other such companies and have had some software that I developed stolen and I will not allow that to happen again.

      In the FX animation folder I used the ice shard picture and put a few of them into image frames of a blizzard spell and have the blizzard spell cast it on all enemies.

      Now I am not saying that what Mr Durham posted was wrong, just that it was different than the official liscensing agreement and if Ambrosia has changed the liscensing agreement there should be a new one that we can download.

      Now I do not have a problem shelling out $3000 in licensing (I actually thought that it would be closer to 5000) for unlimited licensing. I know that I have to save up for it and have at least another year to do so, but the thing I do have a small problem with is that two seperate people from Ambrosia saying two opposite things.

      I do not want to start an embroiled arguement over this but it would be nice if somebody from Ambrosia could very clearly define this in relation to the licensing agreement.

    • He didn't mince words. That agreement above is clear. You guys are reading too much into the word commercial.

      Offer a demo of your game, or the full thing, and incorporate a registration method: you and ASW need not speak

      Offer the game commercially, in a boxed version, no demo, or Aspyr likes your piece, and will pimp it for you: you owe ASW $3000 (or whatever your quote is)

      Mr. Dunham simply defined commercial as signing an agreement with a publisher or some sort.

    • One way to help assure your game remains yours is to burn all versions of your game plus the master onto a CD. Make sure that your splash startup screen as well as the CD cover has Copyright 2003 yournameorcompany. Then mail it to yourself or your parents or somebody by REGISTERED mail. You'll (or parents or somebody) will have to sign for it. DO NOT OPEN IT. Put it in a safe deposit box. You see, it has the federally-issued date on it then, and this holds up in court quite nicely. You can also trademark your title (if the title isn't already trademarked, in which case you wouldn't use it anyway) and secure a government-issued copyright, which is also what I suggest you do. The combination of these practices really help you keep what you've created. This is not being paranoid; it's just business. Many people are really good people. I believe that the Ambrosia people are really decent. But not everybody is, and that's why the cautionary measures.

    • oh oh oh, that reminded me deb, some post offices and most office supply stores sell tamper proof thick seal envelopes that cant be opened without cosmetic damage. you used to be able to open envelopes by heat or chemical release outside the envelope. the new tamper proofs have a glue that chemically seals into the paper. these arent envelopes you lick and stick. theyre good stuff. i already bought some and shipped some art and game logos and what not back to myself.

      also another thing you can try is getting web space and stashing a few select files on it. you can download the files from the server and view the creation dates. pending someone could change creation dates which you can do easily you can obtain info from your host server on what day certain files were uploaded. mail idea is betta though........

      No, there isn't anything silly about it. Obviously you have been in that position before to see someone laugh 'evily' in your face while they said that your idea that you had proposed to them two months ago is/was/will be entirely their idea. And I never said that Ambrosia was any kind of company, I simply stated what had happened with past company dealings. And yes a simple NDA agreement signed by both parties would probably would have done the trick, only that I wasn't over the age of 18 to do so, so any contracts became null and void signed 'by a minor'. Now the bad feelings come back all over again. Thanks a lot, dampeoples.......For a trip down memory lane.......
