    • Is this legal?


      Ok, if you have seen my webpage you'll know that the "catchphrase" or whatever for my game is Enter the Enchanted. It has been brought to my attention that this title is used by K. A. Applegate in the Everworld book series as a title for a book. Is it still legal to use it??

    • Well Im no lawyer but I'm pretty sure that you should change it. Even if it is legal, it will probably be seen as cheesy by people who have read those books. Then again, you might want to take the chance that we don't all know how to read. 😃

    • I don't believe names can be copyrighted.... For example, I have heard there is a movie called Escape Velocity.

    • I doubt they would have copyrighted a name. Unless you live in some weird country where there is no freedom of speech, you can use whatever name you want.

    • Names can be copywritten for use in a specific field or medium.

      For example, let's say your parents have a sick sense of humor and decided to name you Billy Joel, after the singer. Because Billy Joel the singer has copywritten his name, you could not pursue a career in music (it doesn't matter what genre, classical, rap, techno, etc) without encountering tremendous legal pressure (or even a mandate) to change your name.

      Another example is Apple. When Apple computer first started up and named themselves Apple Computer, Apple Records (I think they only reason they're still around is because they signed the Beatles) threw a hissy fit. Never mind that they were in different industries. So Apple Computer agreed never to advertize the musical capabilities of their machines. Keep in mind that this was back in the Apple I days, when they were still a small company without multi-million dollar resources, and before anybody imagined the computer music revolution that lay ahead.

      It might be best to avoid naming your game after part of a book or other fantasy series, especially if you're deriving inspiration from it.

      Substitute "trademark" for "copyright" and what you said is fairly accurate.

    • Perhaps I'm wrong, nwa728, but if you're naming a game your making after a copyrighted/trademarked/whatevered book and you give it away freely and don't make any money and don't degrade the book, I don't think the FBI will be hunting your as down.

    • Um, no, the name of my game is "The Unreal Time", it just says Enter the Enchanted after its name because it's its "catchphrase" or whatever you want to call it. In english-It sounds good. I just want to know if its legal to use a phrase in something that could be sold for money, because I might sell it.

    • My advice to all, worry about selling after your game is completed or is near-completion.
