      Foundation is my idea for an EVN universe. Based on Isaac Asimov's books, it takes you through book one to book five, and beyond.       Right now, I am just writing the outline and text for the missions. And of course, I still have to figure out NovaTools! :eek:

      Get that stick out of your ass, IE. Unless you distribute something for profit, copyright holders don't usually care - EV plugins are pretty insignificant. Why are you trying to scare him?

      :eek: You did scare me, IE! 😉 I posted a question regarding it at asimov.com, anyway. SOmeone replied an said I do, even though it is free. Now, where do the heck do I get that permission from?? Hmmm...Did the creator of the Star Wars plug get any permission?

    • generally, you do need a written permission as soon as you distribute (even for free) material containing ideas, names, phrases, etc... that are copyrighted. As Regulus said, if you dont do it for profit, they will normally not engage any procedures against you. But it is always more polite if you ask permission or at least tell them you will use their material. You know, its always a bit schocking for an author when he discovers his material in someone other's work and he can get really angry if you integrate it in a work that does not represent his covictions or his own work.

      His publisher, or estate holder (wife and kids), however might object and would be quite entitled to.

      Steps:

      1. Try contact the publisher (check the spine of a recent edition)
      2. Or his agent
      3. Or his widow/ kids.

      It is possible they would object. My hunch is that they would be supportive.

      One complication may be the more recent additions to the series by other writers - they may have received copyright on the original. Again, my hunch is they are more likely to be supprtive than to object - provided there is no profit.

      Also, the original three are 60 years old. It is possible (but unlikely) that he never renewed the copyright....

      Just found out that in both Europe and the US copyright lasts for 70 years after the authors death.

    • Which is really stupid, if you think about it. You're dead. Widow(er) and children I can understand, but the reason copyright was extended was so that a vastly rich company could become vastly richer...

      I'm inclined to agree, (although as a writer I appreciate intellectual property 🙂 ). I understand that it was only relatively recently that US law extended the time.

      Having said that (and as an example of how such things can do good ) Great Ormond Street Children's Hospital in London received all the royalties from Peter Pan, and under a special arrangement I believe still does, deapite the 70 years passing.

    • Whether dead or alive, it's always important to document credits to whom you've based some ideas from, at least this way, they won't turn over in their graves.

      I think you don't need permission from those guarding the legal rights of stuff from dead people for using their ideas for your project. And if you do use ideas from them for non-profit reasons, you must always state and document their recognition and stuff. This at least you have to do I think.

      So if you're taking some concepts from Isaac Asimov and putting it in your project for non-profit reasons, I don't think you need his permission because he's dead. But you still have to add recognition, you know "Blah Blah based from Isaac Asimov" or something like that. Just...you know, whatever, so everyone who's dead or alive are all honky dory.

    • If that pretty picture up top is the splash screen, just add "based on the novels by Isaac Asimov" beneath "Foundation" and I doubt anyone will care. It might even inspire some people to read the books.

      the best idea is to ask permission. Aitch is correct; start with the publisher. describe what you're doing (clearly and succinctly), and try to explain why it will benefit the copyright holder and have no direct impact. be clear that you are not doing it for profit.

      many copyright holders, if they respond at all, will say no. if that's the case, drop your project, or make sure that you never distribute it.

      many people believe that the lack of a response is tacit consent. many people simply wait for a "cease and desist" letter, ordering you to stop your infringement (these letters almost always precede the filing of a lawsuit). many of these people get sued. your chances of getting the letter, as opposed to being sued, increase if your original letter (1) specified that the lack of response by a reasonable time will mean consent, and (2) was actually received (e.g., certified mail) by the true holder of the copyright. but if you don't get explicit consent, you are still taking a chance.

      The owner of the intellectual property may care, and is legally entitled to care. And once lawyers get involved....

      Personally, I think if they said 'No' that would officially classify them as arseholes, in exactly the same way Paramount became arseholes when they forced Compuserve to remove all Star Trek sounds from its libraries.. Everything I've read by and about Asimov (which is quite a lot) leads me to think he would say 'Sure, as long as I get to play it first and veto anything I don't like.' But the law is the law.

      I'm not saying 'don't do a Foundation plug'. I commented elsewhere that I think it would be a great mileau. I'd definitely play it. BUT do it with open eyes.

      Besides, it's good manners and we alway need more of that 🙂

      I would also add that if you explain to the IP holder about the EV community, they might just think 'Wow, that's kinda neat. It could help us sell more books. How can we help you?' Never know...
